Former -lab director’s lawsuit alleges Maine hospital fired him for raising safety concerns

A former laboratory director at York (Maine) Hospital filed a lawsuit alleging he was fired after raising patient safety concerns, in violation of whistleblower protections and age discrimination laws, according to court documents reviewed by Becker’s.

The lawsuit, filed March 2 in the U.S. District Court for the District of Maine, alleges Marc Dube was fired in June 2023 at age 57, one day after raising concerns that staff were not following quality control protocols for laboratory testing.

According to the lawsuit, Mr. Dube, who worked at the hospital from 1999 until his termination, most recently served as laboratory director overseeing operations across hospital labs, walk-in clinics and medical practices. He notified practice leadership and called for testing in medical offices to be shut down until the issues were addressed. He was fired the following day after the hospital’s COO was brought into the discussion, the lawsuit states.

Mr. Dube’s claims include alleged violations of the Age Discrimination in Employment Act — which protects workers 39 and older — the Maine Human Rights Act and the Maine Whistleblower Protection Act.

York Hospital shared the following statement with Becker’s: “Out of respect for employee privacy and confidentiality, we do not comment on individual employment matters. We are, however, firmly committed to upholding all applicable laws and regulations, and to making employment decisions that reflect our values of fairness, respect and integrity.”

Mr. Dube seeks damages, including lost wages and benefits, front pay and compensatory damages, as well as attorney’s fees and other relief, according to the lawsuit.
